SB 1032 allows the Department of Economic Security to charge a fee for dishonored checks, and allows DES (or its agent) to issue a limited income withholding order, under certain guidelines, to any employer, payor or other holder of a non-periodic or lump sum payment that is owed or held for an obligor.
A.R.S. stipulates that the maximum fee for a dishonored check is $25.00, and that additional fees may be assessed for any charges by the involved financial institution. The funds that would be collected as a result of SB 1032 would be deposited by statutory specification, which requires that monies be remitted to the state treasurer and thence deposited into the state general fund, unless otherwise prescribed by law.
