Summary of the proposed strike-everything amendment to SB 1006

SB 1006 allows a county assessor’s property information storage and retrieval conversion and maintenance fund (CAPISRCM) to be established in each county having a population of five hundred thousand persons or less.

 

Provisions

·                     Stipulates that a CAPISRCM may be established in county’s having a population of five hundred thousand persons or less.

·                     Creates a delayed effective date of December 31, 2001

·                     Authorizes the board of supervisors to administer and, in cooperation with the county assessor, spend the fund monies in order to defray the cost of converting the county’s property information storage and retrieval system to micrographics or computer animation.

·                     Specifies that fund monies shall only be used to purchase hardware and software, including a graphical information system and to train employees.

·                      Requires the county general fund to reimburse the CAPISRCM fund for all improper and inconsistent expenditures as determined by the auditor general.

·                      Allows the board of supervisors to collect a special recording surcharge of up to four dollars for each instrument, paper or notice filed with the county recorder, which will be deposited in the CAPISRCM fund.

·                      Clarifies that the board of supervisors must approve the special assessment fee.

·                      Requires the county recorder to submit to the board of supervisors an annual amount of projected revenues to be raised for the CAPISRCM fund.

·                     Stipulates that any implementation resolution shall contain the following:

Ř      a determination of the total amount of monies and schedule of time required to implement the systems.

Ř      an estimate of the annual fees to be collected.

Ř      an automatic repeal of the authority to impose and collect the assessment fees when enough monies have been collected to assess the system or the original time schedule is completed.

·                      Allows the county recorder to collect all monies for the fund.

·                      Establishes a delayed repeal date of December 31, 2006.

The Counties & Municipalities Committee adopted the strike-everything amendment.

The strike-everything amendment to SB 1006 was adopted in the Committee of the Whole with the following changes:

·                     Prohibits the county recorder from assessing a special recording fee on documents that are exempt from any fees or surcharges by law.
