HCR 2014 proposes a Constitutional amendment to make persons accused of a domestic violence offense ineligible for bail under certain circumstances.

 

History

 

The Arizona Constitution provides that all persons who are charged with a crime shall be eligible for bail.  There are three exemptions from this provision for persons charged with:

 

1.      Certain capital offenses.

2.      Felony offenses committed while the person charged was released on bail for a separate felony charge.

3.      Felony offenses where the person charged poses a substantial danger.

 

Provisions

 

·                      Adds domestic violence offenses where no conditions of release will reasonably assure the safety of another person or the community to the list of offenses that are ineligible for bail.

 

·                      Provides that this amendment be known as Cassie’s amendment.

 

·                      Requires the Secretary of State to submit the proposed amendment to voters at the next general election

·                      Removes language that names the amendment Cassie’s amendment.

 

HCR 2014 was amended in Committee of the Whole as follows:

 

·                      Adopted the Judiciary Committee amendment.

 

·                      Adopted a technical and conforming change recommended by the Rules Committee.
