            HCR 2013 puts before the voters changes to the Arizona Constitution with regard to the jurisdiction of the Arizona Supreme Court.

 

History

            Arizona Supreme Court Rule 28 allows any person interested in changing a court rule to file a petition with the Clerk of the Supreme Court. The petition must state the grounds for the proposed change, and include a draft of the new or amended rule.  The petition may also be accompanied by supporting documentation. After submitting the petition the court may take several steps in considering the proposed change. These include circulation of the proposed change for public comment, public hearing and decision. If the proposal is rejected or submitted to committee, the petitioner must be notified by mail. 

 

Provisions

·                      Makes the Arizona Supreme Court’s procedural and evidentiary rules subject to amendment or repeal by legislative action, initiative or referendum.

 

·                      Stipulates that the authority to adopt substantive, procedural and evidentiary laws is a legislative power inherent in the legislature and the people, and it shall not be infringed upon by the Supreme Court.

 

·                      Requires the Secretary of State to submit the amendment to the voters at the next general election.

 

HCR 2013 failed to pass the Judiciary Committee.
