HCR 2001 increases term lengths for state legislators, limits terms to three for Representatives and two for Senators, creates A and B seats within a legislative district of the House of Representatives, staggers seat elections and requires county boards of supervisors to designate legislative seats.

 

History

Current law prescribes term limits for state legislators, beginning with the January 1, 1993 term of office.  The terms of office are limited to four consecutive two-year terms.   Upon serving the final term of office, a legislator may not serve again in that same office until the legislator has been out of office for at least one full term. 

 

Provisions

·                      Maintains current term limit law through the 45th Legislature.

 

·                      Prescribes, beginning with the 46th Legislature, four-year terms for Representatives and six-year terms for Senators.

 

·                      Limits, beginning with the 46th Legislature, terms of office for Representatives to three terms and Senators to two terms.

 

·                      Increases the length of terms, beginning with the 46th Legislature, as follows:

1.      A legislator who began office in 1999 and serves two consecutive terms is eligible to serve one additional term.

2.      A legislator who began office in 1997 and serves three consecutive terms is eligible to serve one additional term.

3.      A legislator who began office in 2001 and serves one term without prior consecutive service is eligible to serve two additional terms.

 

·                     Establishes, beginning with the 46th Legislature, A and B legislative district seats in the House of Representatives.

 

·                     Requires, beginning with the 46th Legislature, county boards of supervisors to designate the legislators-elect who will hold seat A and seat B.  Seat A will be elected to a four-year term and seat B will be elected to a two-year term.  All subsequent terms in the House will be for staggered four-year terms.

 

·                     Prescribes, for legislative districts with more than one county, a single group vote for each county board of supervisors, when determining A and B legislator-elect seats.

 

·                     Requires the Secretary of State (SOS) to submit this proposition to the voters at the next general election.
