HB 2632, the Capital Outlay Appropriations Act, makes various General Fund (GF) and Other Fund (OF) appropriations in FY 2002 and FY 2003 for the major maintenance and repair (or “building renewal”) of state agency buildings and for new capital projects.  HB 2632 also contains other appropriations and miscellaneous provisions dealing with state capital needs as necessary to balance the state’s FY 2002 and FY 2003 biennial budget.

Specific Provisions

·                      Appropriates $30,397,700 GF and $13,750,300 OF in FY 2002, and appropriates $32,568,700 GF and $14,993,500 OF in FY 2003 for the major maintenance and repair, or “building renewal”, of state buildings.  (See the table entitled “Major Maintenance and Repair” on the following pages).

·                      Appropriates $5,317,400 GF and $322,782,600 OF in FY 2002, and $155,900 GF and $328,280,100 OF in FY 2003, for new capital projects.  Of these amounts, the most significant are the appropriations of $277,963,000 in FY 2002 and $303,864,000 in FY 2003 from the State Highway Fund (SHF) for the planning and construction of state highways. (See the table entitled “Major Capital Projects” on the following pages).

·                      Amends Laws 1999, 1st Special Session, Chapter 2 (the “capital outlay appropriations act” from the previous biennium) to reduce Corrections Fund appropriations by $11,980,000 in FY 2000, $21,957,400 in FY 2001, $23,950,000 in FY 2002 and $21,950,000 in FY 2003, as well as GF appropriations of $64,980,800 in FY 2002 and $8,119,700 in FY 2003.  These appropriations were enacted for the purposes of designing and constructing a 4,200-bed prison complex in Tucson.

·                      Reduces the $20.0 million GF appropriations in each of FY 2002 and FY 2003 for the Highway Expansion and Extension Loan Program (HELP) Fund by further amending Laws 1999, 1st Special Session, Chapter 2.

·                      Appropriates $2,342,900 GF in each of FY 2002 and FY 2003 to the Department of Administration (ADOA) for the Certificate of Participation (COP) costs for the lease-purchase of the design and construction of a state health laboratory and related infrastructure. The bill also gives the Director of ADOA the authority to enter into a lease-purchase agreement for the issuance of COPs in an amount not to exceed $30.0 million for the state laboratory.

·                      Appropriates $1.6 million GF in both FY 2002 and FY 2003 to ADOA for the Certificate of Participation (COP) costs for the lease-purchase of the design and construction of a state archives building and related infrastructure.  HB 2632 also gives the Director of ADOA the authority to enter into a lease-purchase agreement for the issuance of COPs in an amount not to exceed $20.0 million for the state archives building.  In addition, HB 2632 requires that the building be named after Polly Rosenbaum.

·                      Includes a session law provision requiring ADOA to report on the status of project specific FTE positions for capital projects in its capital budget request. That provision allows ADOA to allocate FTEs to other projects initiated HB 2632 provided that funding for the FTE is cost-allocated among the projects, and requires ADOA to report any such reallocations to the Joint Committee on Capital Review (JCCR) by December 31, 2001 and 2002.

·                      Provides that, unless otherwise specified, monies appropriated by HB 2632 cannot be used for personal services or employee-related expenditures, except for any services provided as part of the inmate construction program for correctional facilities.

·                      Provides that the appropriations made by HB 2632 do not lapse until the purpose for which the appropriation was made has been accomplished or abandoned, or unless the appropriation stands for a full fiscal year without an expenditure or encumbrance.

 

HB 2632 left the Appropriations Committee unamended.
