As Transmitted To The Governor

Allows a person age 16 or older to provide direct care to residents in nursing care institutions.

History

In the past two years the informal meetings of the Long Term Care Task Force have come up with several recommendations to improve long term care services for patients.  One such recommendation was to allow 16 and 17 year olds to provide direct care to residents, as there are currently several programs existing to train high school students in this field.  Currently, the Department of Health Services has a rule that requires persons providing direct care to residents to be at least 18 years old, and thus prohibits 16 and 17 year olds from providing direct care.  The concern was raised in Long Term Care Task Force meetings that qualified people are not able to provide services that are needed in nursing care institutions solely because of their age.

Provisions

·                      Prohibits DHS from adopting any rule that would exclude persons 16 and 17 years old from being employed by nursing care administrators to provide direct care to patients in nursing care institutions.
