HB 2611 redefines a major amendment to a municipality general plan.

A proposed strike everything to HB 2611 will be offered in the Natural Resources & Agriculture Committee.  The proposed strike-everything allows a county to retain certain lands that are operated as parks.

History

Current law outlines the procedure for one city to deannex land and another city to annex that land.  Statute provides specific criteria that must be followed including the following conditions:

·              the land must be contiguous to the city which will annex the property.

·              each city involved must pass an ordinance describing their intent.

·              the county board of supervisors must schedule a public hearing within a certain time frame.

·              written notice must be given to the owners of the property subject to deannexation.

·              if a majority of the property owners object to the deannexation, the request to deannex will be denied by the county board of supervisors.

Provisions

·              Prohibits a city or town from annexing a county owned or operated park, or land that is owned by a flood control district.

·              Establishes a process for a city to deannex county owned or operated park land or land owned by a flood control district.
