House Bill 2582 allows public agencies to use on-line biding for the purchasing of goods, services, construction and information services.

 

History

Currently, the majority of State procurement is carried out using a paper process.  A public agency distributes solicitations and notices through paper documents and receives bids on those offers on paper as well.  A growing number of solicitations and notices are being posted on the D.O.A.’s web-site.

 

Provisions

 

 

·                      Defines in statute: CONSTRUCTION, INFORMATION SERVICES, INTERNET, ON-LINE BIDDING, PROCUREMENT, PUBLIC AGENCY, and SERVICES.

·                      Allows public agencies to obtain bids for goods, services, construction and information services using electronic bidding.

·                      Specifies that an opening date and time be designated.

·                      Allows the closing date and time to be fixed or to remain open.

·                      Requires the closing date and time must be included in the solicitation.

·                      Requires bids to be accepted from the beginning of the bidding process until the official close.

·                      States that on-line bids must be posted electronically and be updated on a real-time basis.

·                      Allows public agencies to require bidders to register prior to the bid, specify terms and conditions, and establish other solicitation requirements.

·                      Allows public agencies to prequalify bidders and limit the participants to those who have prequalified.

·                      States that public agencies retain their right to designate the criteria for making awards.

·                      States that all-electronic bids are public information and are bound by the same public disclosure laws as traditional sealed bids.

·                      Extends the remedies available to public agencies and to bidders that apply to the sealed bid process to include public agencies and bidders in an on-line bidding process.

·                      Establishes the State Electronic Commerce Fund consisting of monies appropriated by the legislature and any gifts, grants or devises that benefit the fund.

·                      States that the Department of Administration shall administer the fund.

·                      Permits monies to be appropriated continuously and remain exempt from provisions pertaining to the lapsing of appropriations.

·                      Designates the fund to help finance electronic commerce initiatives.

·                      Authorizes the department to disburse monies to public agencies based on requests and statewide electronic commerce priorities.

·                      Stipulates that a public agency that has received monies from the State Electronic Commerce Fund to establish electronic commerce initiatives must repay the fund plus a percentage of the savings if a savings has been realized through its implementation.

·                      Allows the public agency to retain the remainder of the savings.

·                      Specifies that monies be invested and divested by the state treasurer and the profits credited to the fund.

·                      Contains an emergency clause.

 

HB 2582 passed the Energy Utilities & Technology Committee unamended.
