House Bill 2541 establishes an energy code and a State Energy Code Advisory Commission to review and recommend changes to the state energy code.

History

Last year the Energy Efficiency Codes Study Committee made the recommendation that Arizona develop a voluntary model energy code.  Currently over half of the states have adopted commercial codes and about one-third of the states have adopted residential codes that seek to reduce energy consumption.

 

Provisions

·                      Establishes a state energy code based on the codes drafted by:

-          The International Energy Conservation Code for Residential Construction

-           The American Society of Heating and Refrigeration Engineers Energy Conservation

·                      Establishes a State Energy Code Advisory Commission.

·                      Designates the state energy code as a legislative tool to create incentives for the use of energy saving devices and practices.

·                      Stipulates that members serve a three-year term.

·                      Clarifies that members will not be compensated, but rather reimbursed for expenses.

·                      Requires the Department of Commerce Energy Office to provide staff support to the  State Energy Code Advisory Commission

·                      Allows the Energy Code Advisory Commission to review and recommend changes to the state energy code through an open, voluntary and consensus process.

·                      Stipulates that the State Energy Code Advisory Commission terminates on July 1, 2011.

·                      States that section 41-1511 is repealed on January 1, 2012.

HB 2541 passed the Energy Utilities & Technology committee unamended

HB 2541 was amended in the Committee of the Whole as follows:

·                      Clarifies what editions of International Energy Conservation Code for Residential Construction and the American Society of Heating and Refrigeration Engineers Energy Conservation will be used to draft the state energy.

·                      Designates that no more than two members of the public serving on the commission, that are appointed by the Speaker of the House, be from the same political party

·                      Designates that no more than two members of the public serving on the commission, that are appointed by the President of the Senate, be from the same political party

·                      Requires that an annual report be submitted.

·                      Requires the appointing authority to designate the term ending dates of the appointee.
