HB 2536 removes the requirement for persons applying for a covenant marriage to include their social security numbers and stipulates that social security numbers submitted in applications for marriage licenses shall be available only to DES unless otherwise specified by the applicant.

 

History

Current statute requires persons wishing to marry to apply to the clerk of the superior court for a license, and the persons must sign an affidavit under oath.  The affidavit must state the names, ages, social security numbers and places of residence of both persons wishing to marry.  For covenant marriages, the husband and wife must submit their names and social security numbers in a sworn statement to the clerk of the superior court.  HB 2536 removes the requirement that social security numbers be provided for both marriage licenses and covenant marriages.

 

Provisions

·                      Stipulates that the Superior Court shall not release the social security number of a person that has applied for a marriage license to any person or entity, unless requested by the applicant.  DES is exempt from this provision for child support enforcement purposes.

·                      States that notice of this policy shall appear in each application for a license.

·                      Removes the requirement that persons applying for a covenant marriage must include their social security numbers in the application.
