HB 2523 modifies the requirements of the State Land Commissioner regarding appraisals of state lands.

 

History

The Arizona State Land Department was established to manage state trust lands and resources to enhance value and optimize economic return for trust beneficiaries.  Monies that are collected from the sale or lease of state trust land are deposited into funds that benefit the 14 beneficiaries, with the largest beneficiary being the Common Schools.  The Department administers all laws relating to lands owned by, belonging to, or under the control of the state.

The State Land Commissioner is appointed by the Governor to serve as the executive officer of the Department. Duties of the State Land Commissioner include: making long-range plans for future use of state lands; promoting the orderly development of state lands; and classifying and appraising state lands for the purpose of sale, lease or grant of rights-of-way.

The Uniform Standards of Professional Appraisal Practice (USPAP) are promulgated by the Appraisal Foundation, which is a non-profit organization established by the appraisal profession in the United States in 1987.  Currently, the USPAP are the generally accepted and recognized standards used to appraise real estate, personal property and businesses.  The Standard 3 Review is a type of review that is embodied in the USPAP and establishes a procedure for an appraiser to follow when reviewing another appraiser’s work.

Provisions

·              Requires that all appraisals of state lands, conducted by the State Land Department or by independent appraisers, comply with the Uniform Standards of Professional Appraisal Practice that are set by the Arizona State Board of Appraisal.

 

HB 2523 was amended in the Counties & Municipalities Committee as follows:

·                     Requires a Standard 3 Review to be completed for all appraisals in excess of $100,000.

 

 

A strike-everything amendment to HB 2523 was adopted in the Natural Resources & Agriculture Committee.  The proposed strike everything amendment provisions are as follows:

 

·              Requires a Standard 3 Review for proposed fee simple sales of state land if the estimated value exceeds $250,000.  (Fee simple sales apply to the sale of real property without condition for future use.)
