HB 2520 clarifies the definition of an employee, adds a provision relating to employers who pay wages with an instrument drawn on insufficient funds, establishes requirements for payroll records and specifies violations for noncompliance.

History

The Industrial Commission of Arizona is a regulatory agency that was created in 1925 and is responsible for the administration and enforcement of laws and regulations that relate to the protection of life, health, safety and welfare of employees within Arizona.  The Commission resolves issues involving payment of wages and currently receives approximately 3,000 claims per year.  Under current law an employee may either submit a claim for a wage dispute in writing to the Commission or may resolve the dispute through civil court.

Provisions

·                      Includes aliens and minors that are both legally and illegally working in the definition of an employee as it relates to wage payment requirements.

·                      States that an employer that pays employees from an account with insufficient funds is considered as failing to pay wages.

·                      Requires employers to provide payment statements to all employees with each paycheck that includes information relating to hours and dates worked, gross and net wages earned and deductions.

·                      Establishes requirements for employers to keep payroll and address records on each employee for at least two years.

·                      Requires employers to keep a written record of all employee deductions that are made from cash payment of wages on file for at least three years.

·                      Permits current and former employees to examine payroll records.

·                      Exempts the state, political subdivisions and employers who hire people as personal assistants or personal childcare providers from the payroll requirements.

·                      Stipulates penalties for failure to comply.

·                      Allows the Industrial Commission of Arizona to examine and inspect payroll records.
