HB 2518 stipulates that any person arrested for prostitution to be subject a court order that requires them to be tested for the Human Immunodeficiency Virus (HIV) or other sexually transmitted diseases.

 

History

Current statutory language does not provide for the testing of persons arrested for prostitution.  According to the Arizona Department of Public Safety, there were 2,313 arrests for prostitution in Arizona in 1999.  Approximately 1,500 of those arrests occurred in Maricopa County.

 

Provisions

·                      Requires a person arrested for prostitution to be subject to a court order requiring that person to be tested for HIV or sexually transmitted diseases.

·                      Defines submitting entity as one of the following:

1.      A local health department.

2.      A health unit of the Department of Corrections.

3.      A health unit of any detention facility.

4.      A physician licensed pursuant to Title 32, Chapter 13, 17 or 29.

·                      Requires the submitting entity to determine the type of specimen necessary for laboratory testing by the Department of Health Services or another licensed laboratory.

·                      Specifies the testing laboratory report the test results to the submitting entity.  The submitting entity shall then provide the results to DHS or a local health department.

·                      Requires the submitting entity or DHS to notify the person tested of the results and provide counseling regarding the health implications of those results.  If the submitting entity does not notify the person tested of the results, the submitting entity shall report the name, last address of record and the test results to DHS or a local health department for notification purposes.

·                      Specifies that test results shall only be provided to the person tested, the submitting entity and DHS.
