HB 2511 prohibits a public agency from observing private property through a public monitoring device without a court order and specifies that a public monitoring device shall only be used to observe public property.

 

Provisions

·                      Allows the use of a public monitoring device only if directed at public property.

·                      Prohibits a public agency from aiming a public monitoring device at private property or viewing private property through a public monitoring device unless a court order has been obtained.

·                      Defines a public monitoring device as a video camera, computer monitor or other electronic device whether or not an observation is recorded.

·                      Defines related terms.

 

The Transportation Committee adopted a strike-everything amendment.  The strike-everything to HB 2511 establishes a study committee to examine the use of public monitoring devices and related legislation in other states and countries.

 

Provisions

·                    Creates a study committee to examine the use of public monitoring devices, potential guidelines for public monitoring devices, and legislation on public monitoring devices in other states.

 

·                    Specifies that the public monitoring devices study committee will have the following members:

§         Two members of the House of Representatives appointed by the Speaker of the House

§         Two members of the Senate appointed by the President of the Senate

§         Two public members appointed by the President of the Senate and the Speaker of the House of Representatives

§         One member representing the Department of Transportation appointed by the Governor

§         One member representing the Department of Public Safety appointed by the Governor

§         One member appointed by the Chief Justice of the Supreme Court

 

·                    Requires that the committee submit a report to Speaker of the House of Representatives, President of the Senate, and Governor by December 1, 2001.

 

·                    Contains a delayed repeal date of December 31, 2001.

 

 

 

The Transportation Committee adopted the proposed strike-everything amendment.

 

HB 2511 as printed passed the Retirement & Government Operations Committee unamended.

 

The Transportation Committee amendment was adopted in the Committee of the Whole and amended as follows:

·                    Modifies the study committee membership by adding one member who represents local law enforcement and is appointed by the governor.
