HB 2510 declares that a person who files a complaint with the Department of Economic Security (DES) Child Protective Services (CPS) is responsible for the costs of the investigation if specific conditions apply.
The Human Services Committee adopted a strike-everything amendment to HB 2510 as follows:
· Declares that a person who makes a complaint to CPS is responsible for the costs of the investigation if all of the following apply:
· The complaint is determined to be false.
· The person is determined to have acted with malice.
· The complaint is referred to law enforcement.
· States that a person who files a complaint and is determined to be responsible for the costs of an investigation shall be issued a copy of the right to an administrative appeal within DES.
· Requires DES to adopt rules to determine what constitutes a false report and the administrative appeal rights of a person who files a report that is determined to be false pursuant to the criteria above.
HB 2510 was amended in Committee of the Whole as follows:
· Adopted the Human Services Committee amendment.
· Amended the Human Services Committee amendment by requiring DES to determine an appropriate administrative appeals process, and removes language relating to the courts and the determination of due process rights.
