CPS; investigations
HB 2510 declares that a person who files a complaint with the Department of Economic Security (DES) Child Protective Services (CPS) is responsible for the costs of any further investigation after an initial finding by CPS if the continued investigation confirms the findings of the original investigation. Additionally, HB 2510 requires DES to purge all records of an unsubstantiated complaint within six months or the subject of the complaint is entitled to a civil penalty of $1000.
The Human Services Committee adopted a strike-everything amendment to HB 2510 as follows:
· Declares that a person is responsible for the costs of a CPS investigation if all of the following apply:
· The complaint is determined to be false.
· The person is determined to have acted with malice.
· The complaint is referred to law enforcement.
· States that a person who files a complaint that is determined to be false shall be issued a copy of the person's due process rights.
· Requires DES to adopt rules to determine what constitutes a false report and the due process rights of a person who files a report that is determined to be false pursuant to the criteria above.
