As Passed the House

House Bill 2496 requires the director of the division for children in the governor’s office to forward all monies from the prevention of child abuse fund to a private foundation on an annual basis.

Background

Laws 1999, Chapter 71 required that beginning no later than January 1, 2000, the Arizona Department of Transportation (ADOT) issue child abuse prevention special plates.  Section 28-2402 establishes the required fee for original special plates and renewal of special plates at twenty-five dollars.  Of the twenty-five dollars, eight dollars is considered an administrative fee to be deposited in the state highway fund and seventeen dollars is considered a donation to be deposited in the prevention of child abuse fund that is administered by the Director of the Division for Children in the Governor’s Office.  The fund is continuously appropriated and is exempt from provisions relating to lapsing of appropriations.  The Director of the Division for Children shall allocate monies to a private foundation that guarantees matching the monies.

Provisions

·                      Requires the director of the division for children to forward all the monies in the prevention of child abuse fund, excluding administrative fees, to the private foundation on an annual basis.

·                      Strikes language that required a statewide entity have documented experience in promoting awareness of child abuse prevention as a condition of receiving monies from a private foundation.

·                      Makes a technical and conforming change.

House Bill 2496 passed the Committee on Transportation unamended.

There is a proposed Appropriations Committee strike-everything amendment to HB 2496 with the following provisions.

·                      Changes the process by which monies are dispersed from the Prevention of Child Abuse Fund.  Under current law, monies are allocated to a private foundation qualified under section 501c (3) of the federal Internal Revenue Code that guarantees matching the monies.  The amendment strikes provisions regarding the current application process and instead sets up a grant process managed by the Director of the Division for Children in the Governor’s Office.

·                      Reduces the percentage of the fund that can be used for administrative expenses down from 10% to 3%.

·                      Allows for gifts, grants and donations into the fund.

·                      Requires the Director to submit a written report on or before December 31 of each year to the Governor, President of the Senate and Speaker of the House of Representatives, Secretary of State and the Director of the Arizona State Library, Archives and Public Records on all expenditures made from the Prevention of Child Abuse Fund. The report shall include all administrative expenses, all grants of monies, the names of grantees and any remaining balance.

·                      Requires the Director to make available to the public a list of all grants awarded.
