HB 2494 allows members of a public body, at the conclusion of an open call, to respond to any comments, inquires and nonagenda items at public meetings.

History

Current law requires that all meetings of a public body where there is legal action must be open to the public. During public meetings, the public body may have an open call at which time members of the public can discuss issues that are within the jurisdiction of the public body. Currently, after an open call members of the public body may only respond to criticism brought forth by members of the public and shall not discuss any items that are not on the current agenda.

Provisions

· Allows members of a public body to respond to any comments, inquiries or nonagenda items made by members of the public during an open call.

HB 2494 was amended in the Counties and Municipalities Committee as follows:

· Stipulates that members of a public body shall not discuss or deliberate on any matters within the jurisdiction of the public body raised during an open call to the public unless the matters have been properly noticed for discussion and legal action.

HB 2494 passed the Retirement & Government Operations Committee unamended.

The Counties & Municipalities amendment was adopted in the Committee of the Whole.

HB 2494 failed to pass Third Read.
