HB 2470 adds a section to Title 13 stating that it is unlawful for a person to use video surveillance in a public place without posting a notice that it is being used.

 

Provisions

·                      States that a person may not use video surveillance in a public place unless a notice is prominently displaced stating that video surveillance is in use.

·                      Exempts certain persons, facilities and locations from the rules regulating the use of video surveillance such as public correctional or custodial facilities, public or private medical facilities for treatment of persons in correctional or custodial facilities, facilities operated by law enforcement agencies and private dwellings.

·                      Authorizes the Attorney General or any county or city attorney to bring action in court against violators.

·                      Allows the court to issue an injunction against the violator without proof of the violation causing any damage or injury, if the defendant is given at least five days’ notice and the court is satisfied that a violation occurred.

·                      Establishes that a violation of this section is a Class 3 misdemeanor. [30 days/$500]

·                      Defines video surveillance as the intentional use of a video or motion picture camera, computer monitor or other electronic device for the purpose of visual observation, whether or not it is recorded.

·                      Defines relevant terms.

 

 

 

HB 2470 was amended in the Commerce and Economic Development Committee as follows:

·          Removes language that persons receiving treatment voluntarily at a public or private facility fall under the facility’s video surveillance exemption.
