HB 2457 would require DEQ to consider whether a proposed permit for siting a solid waste or hazardous waste facility would have or add to a disparate impact on a racial or ethnic population.

 

History

The text of this bill is the same as HB 2612 introduced in 2000.

 

Provisions

·                       Factors to be determined in this process are demographic, geographic, economic, and human health and risk factors.

·                      DEQ shall notify the permit applicant of preliminary findings of any disparate impact and provide the applicant and other interested persons at least sixty days to comment in writing.

·                      The agency may hold a hearing to receive additional comments.

·                      After the comment period, the director shall issue a decision within sixty days. 

·                      The director shall deny a permit if there will be a disparate impact.

·                      The agency shall adopt rules for this process.
