Provisions

 

·        The state fire safety committee shall adopt by rule minimum standards for mandatory electronic filing and reporting for a statewide database that contains information from national and international uniform fire codes, MSDS and hazardous material plans.  The standards would be developed after research and review.  The database shall be developed in cooperation with the Arizona Emergency Response Commission (AZERC) and information from the database shall be made available to local fire departments and other public safety agencies.  (ARS 41-2146)

 

·        Other additional components of the state fire code shall include: compliance with the hazardous materials management plan and the hazardous materials inventory statement requirements of the international fire code (12th edition);  and,  requiring local fire protection jurisdictions to report annually to the state fire marshal on the number and type of fires that occurred in their jurisdiction for the preceding year.  (ARS 41-2146)

 

·        The state fire marshal has enforcement responsibilities for the electronic filing, the hazardous materials management plans and hazardous materials inventory statements and the annual fire reports.   (ARS 41-2163)    A person who violates the electronic filing and reporting requirements would be subject to a civil penalty of not more than $1,000 for each day of the violation.  A violation accrues on the date the person was first obligated to report.  The state fire marshal may waive the penalty if compliance is met within 60 days of the notice and additional extensions of time may be granted.  Monies received from penalties shall be deposited in the state general fund.  (ARS 41-2163.01)

 

·        A person required to prepare or have available an MSDS for a hazardous chemical would have the option to file that report electronically.  The information is to be available to the public except for confidential storage information.  The requirement for a tier I inventory form is removed from statute and the tier II form is modified by adding the following information:

·        Latitude and longitude.

·        North American Industrial Classification System code for the facility.

·        The fire department or district with jurisdiction for the facility, including information whether the facility is on Indian lands.

·        An emergency telephone contact number for that facility's supervisory personnel.

·        The toxic chemical release inventory number as prescribed by section 313 of EPCRA.

·        The time period for the update and submission of a revised list or MSDS to the local emergency planning committee, AZERC and the fire department with jurisdiction over the facility is reduced from 90 days to 60 days when the owner/operator of a facility has significant new information or obtains a new hazardous chemical subject to reporting requirements.  (ARS 26-349)

 

·        The state fire safety committee shall adopt by rule a fee for annual renewal of a permit.  (ARS 41-2146)
