HB 2411 makes technical corrections to an initiative passed by the voters and exempts AHCCCS from the rule making requirements of title 41, chapter 6 ARS.

History

In November 2000, Proposition 204, an initiative measure, was passed into law by Arizona voters.  The proposition requires Arizona to deposit over the next 25 years all money received from the tobacco litigation settlement into a Arizona Tobacco Litigation settlement fund.  Monies from the fund are to be used to increase the amount people eligible for AHCCCS.  The proposition expands the definition of a person eligible for AHCCCS to include anyone having an income level up to 100 per cent of the federal poverty level.  It further specifies that the legislature and AHCCCS may change the eligibility threshold, but only to increase the amount of people that would be included in AHCCCS program. 

 

The Arizona Constitution Article IV, part I, section 1, subsection 6 allows the legislature to amend an initiative measure approved by a majority of the votes cast only if the amended legislation furthers the purposes of such measure.  Initiative measures must be passed by at least three-fourths of the members in each house of the legislature.  HB 2411 makes spelling correction in the Proposition 204 and therefore requires a three-fourths vote for passage.

             

Provisions
