HB 2407 prohibits an agency from including construction standards in a delegation agreement.

 

History

Delegation agreements are an agreement between an agency and a political subdivision that authorize the political subdivision to hold the powers and duties and to carry out the functions of the agency given by law.

 

The process for entering into a delegation agreement is outlined in statute.  An agency must provide information relating to the powers and duties being delegated, performance standards to fulfill the agreement, record keeping requirements, conflict resolving procedures and the contact persons at the agency and political subdivision before entering into the agreement.  The agency must also file the proposed agreement with the secretary of state and hold a public hearing to solicit public comments on the proposed agreement.  Upon hearing the public comments, the agency must prepare a written comment on their decision to enter into the proposed agreement.  The delegation agreement becomes effective 30 days after the written notice is given.

 

Provisions

·                      Prohibits an agency from including construction standards in a delegation agreement.

 

·                      Allows construction standards that are open, voluntary and that have consensus or that are adopted through the agency’s rule making process.

 

·                      Defines consensus as voting rights among all professional and occupational roles.
