HB 2401 establishes a section of statute relating to psychiatric drugs or medications for children.

 

Provisions

·                      Requires a licensed physician, prior to placing a child on a psychiatric drug or medication, to do all of the following:

·                      Obtain a signed informed parental consent.

·                      Allow a pediatrician chosen by the parent to conduct a physical examination of the child.

·                      Address any medical conditions discovered during the physical examination.

·                      Requires the Department of Health Services to annually track and report the number of psychiatric drugs or medications prescribed for children throughout Arizona.  The report shall not contain either the names of the child or the parent.

·                      Declares that a physician is guilty of a Class 3 misdemeanor and has committed an act of unprofessional conduct for a violation of this section.

·                      Defines the term psychiatric drug or medication.
