HB 2399 allows adult probation and surveillance officers to carry a firearm while on duty, and established the Probation System Task Force.

 

Provisions:

·                      States that an adult probation officer or a surveillance officer who supervises an active caseload may carry a firearm while on duty to protect the officer from death or serious bodily harm if the officer completes at least 40 hours of firearms training.

·                      Requires each probation department to contract with an entity to provide firearms training.

·                      Allows the chief probation officer to allow any other officer within the department to carry a firearm.

·                      States that firearms certification and re-certification training shall not exceed the requirements for officers of the Department of Public Safety.

·                      Requires each probation department to provide firearms certification and re‑certification training for its' officers.

·                      Allows a probation department to utilize existing funds to supplement or pay the entire cost of firearms training.  Any funds expended for firearms training shall not reduce the amount of monies utilized for salaries of the officers.

·                      States that each probation department shall provide officers with credentials, which the officer shall possess while on duty.

·                      Requires each probation department to determine the type of firearm and ammunition to be carried by the department's officers.   Firearms must be of recognized manufacture with proven law enforcement use and reliability.  All firearms and holsters must be approved by the chief probation officer.

·                      States that any officer who chooses to carry a firearm while on duty shall purchase the firearm and holster, unless provided by the probation department.

·                      Requires each probation department to provide the officer any ammunition necessary for the performance of the officer's duties, personal protection, safety and firearms certification and re-certification training.

·                      Allows a chief probation officer to deny a probation officer from carrying a firearm with just cause, that shall be a written notice and be placed in the officer's record.

·                      Requires each probation department to adopt rules for the storage, maintenance and inspection of firearms for probation officers while not on duty, and for the carrying and drawing of firearms while on duty.

·                      Establishes the 15-member Probation System Task Force (Task Force) required to research the relationship between probation departments, the administrative office of the courts, presiding superior court judges and county chief probation officers supervising adult, surveillance and juvenile probation officers.

·                      Requires the Task Force to submit a report of the findings and recommendations to the governor and the legislature by December 1, 2001. 

·                      Repeals the Task Force December 31, 2001.

·                      Contains a delayed effective date of July 1, 2002, except as noted for the Task Force.
