The proposed strike-everything amendment to HB 2394 makes technical corrections by clarifying the name of the organization known as Special Olympics Arizona.

 

History

Laws 1991, Chapter 264, created the Special Olympics Tax Refund Fund consisting of the contributions from personal income tax refunds, private gifts and grants, as well as investment earnings collected on behalf of the Special Olympics organization.  The name Special Olympics is a trademark owned by Special Olympics, Inc. and there is only one entity per state [except that California has two] designated as the Accredited Program.  Special Olympics Arizona is the exclusive designee/licensee authorized to us the Special Olympics name. 

 

Currently, there are two different references to the Special Olympics organization in Title 41, Section 173, Arizona Revised Statutes.  The first refers to the Arizona Special Olympics, and the second speaks to a nonprofit entity.  The proposed strike-everything amendment clarifies and corrects these references to read: Special Olympics Arizona as a corporation, thus ensuring that all monies within this fund will continue to be allocated to the authorized organization.

 

Provisions

·                      The proposed strike-everything amendment eliminates all references to Arizona Special Olympics and a non-profit entity and replaces them with Special Olympics Arizona as a corporation.
