HB 2385 establishes the Eviction Prevention and Emergency Homeless Housing Services Program (Program) to be administered by the Department of Commerce (DOC) with the consultation of the Department of Economic Security.

 

Provisions

·                      Establishes that the Program will be administered by the DOC with the consultation of the Department of Economic Security.

·                      Specifies that the Program may include:

·                      Eviction prevention for renters.

·                      Mortgage foreclosure assistance for owners.

·                      Financial counseling for eviction prevention and mortgage foreclosure.

·                      Vouchers for hotels and motels.

·                      Rental security and utility deposits.

·                      Utility assistance.

·                      Short term rental assistance.

·                      Other approved homeless housing services.

·                      Stipulates that a person is eligible for Program services only once in a twelve-month period.

·                      Requires the director to submit an annual report on or before December 31 including statistics regarding the number of persons served in specified capacities.

·                      Establishes the Program fund, to be administered by DOC.

·                      States that the funding will consist of:

·                      Monies appropriated to the fund by the legislature, to be exempt from lapsing.

·                      An additional $1,000,000 transferred to the Housing Trust fund from the proceeds of the sale of abandoned properties and unclaimed properties.

·                      Stipulates that distribution of funds across the state will be on a needs-based formula determined by DOC.

·                      Terminates the Program on July 1, 2010.

 

HB 2385 was amended in the Human Services Committee with a Strike-Everything amendment as follows:

·                      Establishes that the Program will be administered by DOC with the consultation of the Department of Economic Security.

·                      Specifies that the Program may include:

·                      Mortgage foreclosure for owners.

·                      Financial counseling for eviction prevention and mortgage foreclosure.

HB 2385 was amended in the Appropriations Committee with a Strike-Everything amendment identical to the Human Services striker, with the following exception:

·                      Transfers only an additional $1,000,000 of unclaimed property proceeds to the Housing Trust Fund for use by the Program, as opposed to an additional 20% of unclaimed property monies.

 

HB 2385 was amended in the Committee of the Whole as follows:

·                      Withdrew the Human Services Committee amendment.

·                      Adopted the Appropriations Committee amendment.

·                      Amended the Appropriations Committee amendment as follows:

·                      Requires the director to submit an annual report on or before December 31 to including statistics regarding the number of persons served in specified capacities.

·                      Stipulates that participants are eligible for Program services only once in a twelve‑month period.

·                      Makes technical and conforming changes.
