House Bill 2377 outlines the process to establish an intergovernmental public transportation district (IPTD), the board of directors, membership, and powers and duties of the IPTD. HB 2377 provides that an IPTD can only be formed in a county with a population of four hundred thousand or less through petition to the county board of supervisors by the governing bodies of two or more incorporated cities or towns within the county.

Provisions

· Allows an intergovernmental public transportation district to organize in any county with a population of four hundred thousand or less.

· Permits two or more incorporated cities or towns in the same county to become a district with the approval of the county board of supervisors.

· Requires the unincorporated area between organizing municipalities that are not contiguous to become part of the new district.

· Allows unincorporated cities or towns in different counties that meet the population requirement to petition their county board of supervisors to establish a joint district.

· Outlines process for public hearings and requires board to establish district by resolution if the board determines it would serve the public convenience, necessity, safety or welfare.

· States that if the board of supervisors approves the petition to form a district, the board shall establish the boundaries and in the case of a district in different counties, the board shall establish a district by an intergovernmental agreement.

· Allows board of directors to propose to dissolve the district only if all contractual obligations and debts are satisfied.

· Exempts a district from dissolution if the county population grows beyond four hundred thousand persons.

· Outlines the organization powers and duties of the governing body of the district.

· States board shall consist of at least five and not more than nine members.

· Outlines the criteria governing the selection of the board of directors.

· Outlines powers and duties of the board of directors including organizational and procedural structure, authority to hire employees, enter into contracts and pay debts.

· Requires board of directors to issue annual report on or before December 1.

· Prohibits board of directors from exercising power of eminent domain.

· Requires board of directors to conduct a public survey to determine public transportation system needs and the means to finance the system.

· Outlines the components of a five year plan to meet public transportation needs.

· Provides the district with authority to design, operate and maintain the district transportation system.

· Authorizes board to establish regional bus system and community funded transportation services such as dial-a-ride programs.

· Establishes a public transportation district fund.

· Requires the district to appoint a treasurer to administer the fund.

· States the district treasurer shall maintain the fund that includes appropriations from municipal counties, federal monies, grants and revenue collected from operating the public transportation system.

· Authorizes funds to be used for the purpose of the district.

· Appropriates interest and other income from investments to be credited to the fund.

· States an annual audit shall be conducted within one hundred twenty days after the end of the fiscal year.

· Requires that no later than June 30 of each year the board of directors hold a public hearing to adopt and submit to the county board of supervisors and the governing body of each municipality a budget for the following year.

· Outlines components that the budget must include.

· Allows board of directors to amend budget on finding of good cause.
