HB 2357 clarifies county ordinance authority and makes technical corrections.

History

Current law allows a county board of supervisors, when conducting county business, to adopt, amend and repeal all ordinances necessary in carrying out the duties and responsibilities of that county providing they are not specifically limited by existing law or in conflict with any rule or law of Arizona.  HB 2357 specifies county powers, prohibits a county from changing county land use, and prevents a county from charging a fee for land transactions.

Provisions

·              Allows a county board of supervisors when conducting county business to adopt amend and repeal all ordinances necessary or proper to carry out the duties, responsibilities and functions of the county including such procedures, processes, rules and power to implement such ordinances that are not otherwise specifically limited by law.

·              Prohibits a county from changing county land use, planning and zoning except as already allowed in statute.

·              Prohibits a county from charging a fee for land transactions that is not otherwise authorized.

·              Makes other technical and conforming changes.
