HB 2342 provides that it is a class 3 misdemeanor to provide questions or answers to students for required state issued standardized tests.

 

History

Under current law, in order to graduate all students in the state of Arizona are required to pass a competency test in the subjects of reading, writing and mathematics.  The Arizona Instrument to Measure Standards test administers such a test. In addition, all students in the state of Arizona are required to participate in a statewide nationally standardized norm-referenced achievement test for grades three through twelve in reading, language arts and mathematics.  HB 2342 would make it a class 3 misdemeanor (up to 30 days in prison and a $500 fine) to provide answers during the test or to distribute questions and answers before these tests are given.

 

Provisions

·        Provides that if any person knowingly and willfully engage in any of the following they will be guilty of a class three misdemeanor:

§         Provide or make available test questions or answer keys to persons who are likely to take the test;

§         Photocopy or reproduce the test or testing materials that are inconsistent with copyright laws;

§         Use the test or testing materials in a manner that is inconsistent with test security procedures adopted by the Department of Education;

§         Provide answers, suggestions, hints or allow test answers to be shared during the administration of the test;

§         Modify or misrepresent the answers of persons who have taken the test;

§         Fail to report any act that violates this subsection.

 

·        Provides that a person who holds a teaching or administrative certificate from the state board of education and who is convicted of a violation of this section is guilty of unprofessional conduct and the state board of education may revoke or suspend the person’s certificate.

 

HB 2342 failed to pass the Education Committee.
