HB 2286 removes the time limit within which an action to collect jury fees can commence.

 

History

 

Currently, an action to begin a collection of jury fees must be made within three years of recording a judgment if the judgment is recorded in the office of the county recorder within 30 days after the judgment is rendered.  Once the judgment is recorded, the clerk of the court receives a copy of the judgment, including fees.  This information is entered into a billing system, and a bill is generated, including interest.  Historically, some of the judgments default into collections, and, if left unpaid, a lien may be recorded at the county recorder’s office.

 

Provisions

 

·                      Removes the three-year limit for commencing an action to collect jury fees and replaces it with language allowing for the action to commence at any time after the judgment fixing jury fees is recorded.

 

·                      Provides that the judgment does not expire until paid in full.

 

·                      Makes technical and conforming changes.
