HB 2283 allows the $20 time payment fee assessed on each person paying a court-ordered penalty, fine, or sanction to continue with no sunset.

 

History

Current law allows for a fee of $20 to be assessed on each person who pays a court-ordered penalty, fine, or sanction on a time payment basis.  The fee is deposited into the judicial collection enhancement fund (JCEF).  The Supreme Court administers JCEF monies pursuant to ARS section 12-113 to train personnel, improve, maintain and enhance the ability to collect and manage monies assessed or received by the courts including restitution, child support, fines and civil penalties and to improve the court automation projects likely to improve case processing or the administration of justice.  The monies may be used for local, regional or statewide projects.

 

Provisions

·                      Repeals Laws 1999, chapter 175, section 6, which changed the time payment fee from $20 to $12.

 

·                      Repeals ARS section 12-116 as amended by Laws 2000, chapter 193, section 94, which made technical corrections to Laws 1999, chapter 175, section 6.

 

·                      Removes the effective date to change time payment fee from $20 to $12 from and after December 31, 2001 set forth in Laws 1999, chapter 175, section 9.

 

·                      Removes delayed repeal provision from and after December 31, 2001 as set forth in Laws 1997, chapter 79, section 7.
