HB 2265 allows for annual price adjustment in private prison contracts if certain events exist.

History

Current law permits the state to enter into a contract with a private institution for the confinement of individuals who are committed to the Arizona Department of Corrections (ADC). These adult incarceration contracts provide an annual contract price that can be adjusted once yearly. The adjustment allows for an increase in costs which shall not exceed the percentage change that is published in the average consumer price index by the United States department of labor.

Provisions

·                      Provides for an increase in health care costs equal to the percentage change in medical consumer costs as published by the consumer price index.

·                      Allows for a price or cost increase due to any of the following: 1) a catastrophic event; 2) an unanticipated event; 3) an increase in state and local taxes; and 4) an increase in utility rates.
