History

Fire district boards are composed of three to five members depending on the population of the district. Current law requires that an election to fill a vacancy due to term expiration of a board member of fire a district must be held even if there is only one candidate.

Provisions

·                      Allows the board of supervisors to cancel an election for a fire district, elected fire chief or elected secretary treasurer and appoint a nominee if: 1) the vacancy is open only due to a term expiration; 2) only one person has filed a nominating petition; and 3) the board appoints the person who submitted the only nominating petition.

·                     Clarifies that a person who is appointed to the office is granted the same powers and duties as if the person had been elected into the office.
