History

Fire district boards are composed of three to five members depending on the population of the district. Current law requires that an election to fill a vacancy due to term expiration of a board member of fire a district must be held even if there is only one candidate.

Provisions

·                      Allows the board of directors to cancel an election for a fire district and appoint a nominee if: 1) the vacancy is open only due to a term expiration; 2) only one person has filed a nominating petition; and 3) the board appoints the person who submitted the only nominating petition.

HB 2260 passed the Public Institutions and Rural Affairs Committee unamended.

HB 2260 was amended in the Committee of the Whole as follows:

·                     Clarifies that a person who is appointed to the office is granted the same powers and duties as if the person had been elected into the office.
