HB 2238 makes numerous changes to the appropriations and distribution of medically needy account monies and creates a percentage-based formula for medically needy account appropriations effective June 30, 2003.

 

Provisions

·                      Requires the Governor to submit a copy of the executive order when monies are set aside from the health crisis fund for a health crisis or when there is significant potential for a health crises to the Joint Legislative Budget Committee.

·                      Makes the following one-time appropriations and annual changes to the medically needy account allocations:

1.      Removes annual five million-dollar appropriation for the mental health grant program.

2.      Designates $500,000 of the six million dollar annual appropriation for primary care services to be distributed for community based primary care programs to provide primary or urgent care services during evening and weekend hours.

3.      Changes $5 million annual appropriation for qualifying community health centers to $5 million in FY 2001-2002 and $4.75 million in FY 2002-2003.

4.      Reduces annual appropriation for detoxification programs from $500,000 to $375,000.  Of these monies, $250,000 shall be used for programs that provide long-term care and $125,000 shall be used for short-term detoxification treatment.

5.      Reduces annual monies transferred from the Arizona Health Care Cost Containment System (AHCCCS) to the Department of Health Services (DHS) for non-renal organ transplant operations from $250,000 to $70,000.

6.      Appropriates $250,000 in FY 2001-2002 for primary health care services in Tucson designated by the Environmental Protection Agency as a site contaminated in 1983 due to trichloroethylene (TCE).

7.      Appropriates $500,000 in FY 2000-2001 to DHS for emergency vaccines.

8.      Appropriates $200,000 in FY 2001-2002 and FY 2002-2003 to DHS to reimburse health departments in Coconino, Gila, Mohave, Yavapai and Yuma counties.

9.      Appropriates $100,000 in FY 2001-2002 to the Arizona Telemedicine Program to establish a one-year pilot program in school health clinics.

10.  Appropriates $125,000 to the University of Arizona to establish a telemedicine behavioral health program.

11.  Appropriates $1,500,000 to DHS for non-title XIX children’s behavioral health services, including juvenile court programs.

12.  Appropriates $7,000,000 in FY 2001-2002 to provide reinsurance to the HealthCare Group plans.

·          Establishes the following percentage-based formula for distribution of medically needy account monies beginning June 30, 2003:

1.      .56 percent to pay the state’s share of costs for providing monies to AHCCCS for transplants pursuant to 36-2901, 36-2907.

2.      6.68 percent for primary care programs that provide services for low income at risk residents of this state, indigent or uninsured Arizonans.

3.      5.28 percent for grants to qualifying community health centers.

4.      .28 percent for DHS contracts for non-profit organizations that assist in the management of end stage renal disease and related problems.

5.      21.4 percent for the AHCCCS Premium Sharing Program.  This amount is contingent upon the existence of a Premium Sharing fund.

6.      1.07 percent to the health crisis fund.

7.      .53 percent to the aging and adult administration in DES.

8.      .08 percent to DHS contracts to services providers that perform non-renal organ transplant operations.

9.      .12 percent to implement the rural private primary care provider loan repayment program.

10.  12.44 percent for AHCCCS to phase out quick discount payments from previous legislative sessions.

11.  10.70 percent to discontinue the annual discount on private hospital reimbursement.

12.  4.87 percent to provide coverage for extended maternity length of stay for those qualified by AHCCCS.

13.  1.44 percent to fund the costs of HIV/AIDS drug treatment and monitoring.

14.  23.48 percent for the Children’s Health Insurance Program (CHIP).

15.  1.07 percent to DHS for AIDS medications provided through the Arizona Drug Assistance Program.

16.  8.56 percent to DHS for psychotropic medications for seriously mentally ill persons not eligible for title XIX.

17.  .51 percent to DHS for the Arizona Statewide Immunization Information System.

18.  .37 percent to DHS for Hepatitis C diseases surveillance.

19.  Up to four percent may be transferred for each program for administrative costs.

20.  AHCCCS may withdraw .39 percent for required evaluations of medically needy account programs.

·          Permits the transfer of $65.2 million in FY 2001-2002 from the medically needy account for AHCCCS programs.

·          Establishes delayed effective and repeal dates.
