HB 2205 requires that political subdivisions give additional notice for any public hearing regarding a hazardous waste site.

 

History

ARS 49-941 states that any agency or political subdivision which is required to select or permit a possible permanent site for any facility designed to permanently store, treat or dispose of any hazardous substance shall send written notice to property owners in the following areas:

·        Property owners in an unincorporated area that are within a three mile radius to the proposed site.

·        If that three-mile radius of the proposed site intersects a municipal corporate boundary, property owners inside the municipal corporate boundary within three hundred feet of the outer boundary of the proposed site are to be notified.

·        Property owners within a three hundred foot radius of the outer boundaries of the proposed site if it is in an incorporated area.

 

Provisions

·                      The public notification for a hearing in the area of the proposed hazardous waste site is increased from at least two weeks to at least four weeks.

·                      The bill would require a political subdivision to post the information on their webpage at least four weeks before the hearing.
