HB 2196 allows site delivered units to be treated equally as site built homes under zoning ordinances.

 

History

Current law gives no reference to county zoning ordinances for site delivered homes allowing county zoning ordinances to differentiate between site built and site delivered dwellings.  Residential zones and overlays may restrict or exclude manufactured homes.

 

Provisions

·                      Allows site delivered dwelling units to be treated the same as site built dwellings in zoning ordinances.

·                      Permits a county to impose design or aesthetic standards as long as they apply equally to both delivered and site built dwellings.

·                      Authorizes a county to require property owners to file a list of parcels that are subject to deed restrictions or restrictive covenants on the placement or sitting of site delivered units.  Permits the county to charge a fee for filing the administrative notice and relinquishes the county from obligation and liability on county for accuracy of administrative notice files or restrictive covenant.

·                      Defines site built dwelling as a dwelling built primarily on site

·                      Defines  site delivered unit as a new manufactured home or a new residential factory-built home that meets the following criteria:

1.      Placed on permanent foundation or foundation system that are approved by the manufacturer.

2.      At least 960 square feet of livable space and at least 2 sections in width

3.      Affidavit or affixture is recorded and approved by law

4.      Exterior material and appearance are similar to other site built or delivered units in the area per county ordinances.

·        Defines valid deed restriction or restrictive covenant as a restriction or

          covenant that is property recorder under statute that is not invalid by the courts or attorney

         general and that applies to the property in question.

 

HB 2196 failed to pass the Committee on Commerce and Economic Development.
