HB 2196 authorizes new manufactured homes and new residential factory-built buildings to be zoned the same as dwelling units built primarily on-site.  The bill further prohibits any kind of zoning restriction that would differentiate between the types of dwelling units.

 

Provisions

·                      Establishes a site built dwelling as one built primarily on-site.

·                      Defines site delivered unit as a new manufactured home or a new residential factory-built home that meets the criteria as outlined in the bill.

·                      Provides a definition for valid deed restriction or restrictive covenant.

·                      Requires site-delivered dwelling units to be treated the same as site-built dwelling units for zoning purposes.  Prohibits discriminating or imposing different substantive or processing criteria for the two dwelling units.

·                      Permits a county to impose design or aesthetic standards as long as they are uniform and apply equally to both site-delivered and site-built dwellings.

·                      Allows a county to adopt less restrictive standards for site-delivered units.

·                      Allows a county to adopt a process for administrative notice of parcels that are subject to a deed restriction or restrictive covenant for the placement or siting of site-delivered dwelling units.  Outlines the process and allows the county to charge a fee.
