HB 2185 establishes a new section of statute that sets standards allowing for the registration and certification of unregulated child care home providers (caring for four or fewer children) in order to be listed with the Child Care Resource and Referral System as a Child Care Home Provider.

 

Provisions

·                      Establishes that unregulated child care homes shall be subject to background checks by DES for inclusion into the central registry.

·                      Establishes the Child Care Home Provider Registry (Registry) within the Child Care Resource and Referral System (System) to provide families with information about registered Providers, and to include:

·                      Registered Providers.

·                      A complaint tracking system available to the public.

·                      An appeal process for Providers removed or excluded from the Registry.

·                      Information from registered providers relating to the services provided and the child care environment.

·                      Requires that the System:

·                      Assist providers with becoming registered.

·                      Collect the licensure, certification and registration status of providers.

·                      Provide outreach services to include public awareness information to parents and providers about the Registry and its benefits.

·                      Specifies reasons for removal from the Registry to include:

·                      Failure to obtain a Class one or two fingerprint clearance card, or the clearance card is revoked or suspended.

·                      Removal from participation in the Child and Adult Food Program.

·                      Failure to maintain current training and certification in first aid and infant/child CPR.

·                      Failure to properly enclose a pool according to statutory specifications.

·                      Failure to safely store firearms and ammunition separately.

·                      Adds a new section which outlines registration procedures with DES for unlicensed and unregistered child care home providers caring for four or fewer children and who are receiving compensation if the provider wishes to be registered with the System and the Registry.

·                      Requires applicants for the Registry to submit fingerprints for a state and federal criminal records background check.

·                      Requires providers to possess a valid Class one or two fingerprint clearance card, or be in the process of applying by the date of registration with DES.

·                      Stipulates that registrants must include on confidential notarized forms information regarding whether the provider:

·                      Has been convicted of or is pending a trial relating to a criminal offense.

·                      Is a parent or guardian of a dependent child.

·                      Has been previously denied or had revoked similar licensure.

·                      Requires that applicants must:

·                      Not have been the subject of substantiated child abuse or neglect investigations.

·                      Maintain current training and certification in first aid and infant/child CPR.

·                      Enclose any pools in compliance with statute.

·                      Separate and secure storage of firearms and ammunition.

·                      States that DES shall adopt the necessary rules for program implementation, and the director of DES shall charge applicants a fee for processing fingerprinting information.

·                      Specifies the liability or obligation status of the state by referencing statutory liability.

·                      Defines the term child care provider.

·                      Exempts DES from the rule making process until July 1, 2002.

·                      Allows DES to use appropriated quality set aside monies from the Child Care Development Block Grant in FYs 2001-02 and 2002-03 for implementation.

·                      Contains a delayed effective date of March 31, 2002.

·                      Makes technical and conforming changes.
