House Bill 2182 establishes conditions under which the Arizona Department of Transportation Motor Vehicle Division (MVD) orders installation of Ignition Interlock Devices (IID) for persons following reinstatement of their driving privilege after suspension or revocation.

 

The proposed strike-everything amendment to House Bill 2182 makes changes to the sentencing provisions for first-time offenders convicted of driving under the influence (DUI) and increases the fines for DUI convictions.

 

Provisions

·                      Allows the judge to suspend all or part of a jail sentence for a person convicted of DUI if the offense is the first offense and the person completes a court ordered treatment program.  Current statute specifies the judge may suspend all but twenty-four hours of the jail sentence.

·                      Requires the court to find a person in contempt of court if the person does not complete court ordered treatment.

·                      Eliminates the requirement to issue an order to “show cause” to the defendant but retains the requirement to issue an order to “show cause,” as to why the remaining jail sentence should not be served.

·                      Increases the fine from $250 to $500 for the first DUI offense.

·                      Increases the fine from $500 to $750 for the second DUI offense within sixty months of the first offense.

·                      Raises the fine from $250 to $500 for the first offense of Extreme Driving Under the Influence (EDUI).

·                      Raises the fine from $500 to $1000 for the second EDUI offense.
