House Bill 2181 updates and conforms current statutory language regarding fingerprint information submitted by school bus drivers for the purpose of completing a criminal records check through the Arizona Department of Public Safety (DPS) and the Federal Bureau of Investigation (FBI). 

 

History

Laws 1985, Chapter 246 prescribes the requirements for obtaining certification as a school bus driver, and requires applicants to submit a set of fingerprints to the department of public safety for a criminal history record information check. 

 

According to the Arizona Department of Public Safety (DPS), the current statute does not comply with FBI standards for criminal history information sharing.  The language proposed in the strike-everything amendment complies with FBI standards by specifying a full set of fingerprints must be submitted by each applicant of a school bus driver certificate.  In addition, the strike-everything amendment clarifies that criminal history checks are to be accomplished in accordance with state and federal law.

 

Provisions

·                      Specifies that each applicant for a school bus driver certificate must submit a full set of fingerprints to DPS.

·                      Clarifies that DPS is to exchange fingerprint data with the FBI in accordance with state and federal law for the purpose of obtaining a state and national criminal history check.

·                      Clarifies that a school bus driver is to operate an alternately flashing warning signal light when the school bus is a minimum of 100 feet from coming to a stop for the boarding or departure purposes.

·                      Makes technical and conforming changes.
