HB 2122 applies to state employees that are covered by merit system guidelines and who are non-exempt from the Fair Labor and Standards Act (FLSA). The bill requires an employer to pay overtime or award compensatory time at a rate of time and one-half for time worked in excess of an employee’s daily work schedule.
The proposed strike-everything amendment to HB 2122 creates a study committee that shall review issues relevant to state employee overtime pay, including whether overtime pay shall be based on time worked in excess of the employee’s daily work schedule or weekly work schedule.
Provisions:
· Creates a six member study committee comprised of three members of the House of Representatives and three members of the Senate.
· Requires the study committee to review and analyze:
1) whether overtime pay shall be based on time worked in excess of an employee’s daily work schedule or weekly work schedule;
2) the policies of state agencies regarding overtime pay;
3) fiscal analysis of any proposed change in the qualification for state employee overtime;
4) all other issues deemed relevant by the committee regarding state employee overtime pay.
· Requires the committee to submit a report by November 15, 2001.
· Delayed repeal from and after December 31, 2001.
The Financial Institutions and Insurance Committee strike-everything amendment was adopted with no further changes.
