House Bill 2095 makes it illegal for any person under the age of twenty-one years to have any spirituous liquor in their body.  In addition, HB 2095 creates a new section ARS Title 28 to conform to current statute in ARS Title 4 by establishing that the department shall suspend the driver’s license of a person between eighteen and twenty-one years of age if the person is found guilty of operating a motor vehicle with any spirituous liquor in their body.

 

History

HB 2095 resolves the inconsistency between section 4-244 paragraph 33 and section 28-3320 since current statute only allows the department to suspend the license for this violation if the person is under eighteen years of age.

 

Provisions

·                      Prohibits a person under the age of twenty-one to have any spirituous liquor in their body.

·                      Establishes a two year driver license suspension in ARS Title 28 for a person convicted of violating section 4-244, paragraph 33 while the person is eighteen, nineteen, or twenty years of age.

·                      Allows restricted driving for the person convicted between the person’s home, school and place of employment during specified periods.

·                      Defines “conviction.”
