HB 2090 amends the statutes that govern the Industrial Commission of Arizona [ICA].

 

History

The Industrial Commission of Arizona was created in 1925 as a result of the workers’ compensation system established by a constitutional provision. The ICA serves as the regulatory agency for all workers' compensation issues, including claims processing for workers who are injured or killed on the job.  The role of the ICA has expanded over the years to include such labor-related issues as occupational safety and health, youth employment laws, resolution of wage disputes, vocational rehabilitation, workers' compensation coverage for claimants of uninsured employers, insurance carriers that become insolvent, and self-insured employers.  The policy setting body for the ICA is a five-member governor-appointed commission, which oversees the agency's 300 employees and has an operating budget of approximately $14 million.  

 

HB 2090 makes changes to the statutes by clarifying provisions, striking unnecessary language, and making technical and conforming changes. 

 

Provisions

·                      Eliminates the provision relating to the late filing notice.

·                      Clarifies that no insurance or combination of such may be marketed, offered or sold as workers' compensation if it does not comply with law.  An employer who purchases such to secure the obligation to provide coverage for workers is in violation of law. 

·          Strikes the provision requiring the employer to file a certificate stating the new insurance company prior to the cancellation or renewal of the existing policy.

·                      Increases the time period in which a request for hearing may be filed to 90 days [currently 60 days].

·                      Removes the references to the ICA within the context of the independent medical exams.

·                      Makes technical and conforming changes.

 

HB 2090 passed the Commerce and Economic Development Committee unamended.

 

HB 2090 was amended in the Committee of the Whole with technical and conforming changes recommended by the Rules Committee.
