2088 requires the court to meet certain requirements before authorizing the
marriage of a person who is under sixteen years of age.
Provisions
·Stipulates that the court must meet the following
requirements before authorizing the marriage of a person under the age of
sixteen:
1.Requires
the court to mandate that both parties to the marriage complete premarital
counseling.This requirement may be
waived if the court determines that such counseling is not reasonably
available.
2.Requires
the court to find that the minor is entering the marriage voluntarily.
3.Requires
the court to find that the marriage is in the best interests of the minor under
the circumstances.
4.Allows
the court to require the minor to continue attending school and to require any
other conditions deemed reasonable under the circumstances.
