HB 2079 allows a teacher to retire and receive retirement benefits and immediately return to work.
Current law provides that Arizona State Retirement System (ASRS) retired members who engage in work for at least 20 weeks in a fiscal year and for at least 20 hours a week become active members in ASRS. ASRS suspends payment of the member’s retirement benefits until the member either terminates employment or attains a normal retirement date and no longer meets the requirements for active membership. Members are entitled to receive an annuity recomputed to include the additional compensation and credited service.
Laws 2000, Chapter 132 provided a special exemption from the above requirement for teachers (members of ASRS) who return to work. This exemption allows teachers to return to work and continue to be eligible to receive their retirement benefits. However, in order to participate, a teacher has to attain normal retirement age, can not be subject to any disciplinary actions under Title 15 and must leave employment for at least twelve months before returning to work. HB 2079 eliminates the requirement that the teacher must leave employment for at least twelve months. Therefore, the teacher could reach normal retirement age, retire and receive retirement benefits while continuing to work.
