History

The office of the ombudsman-citizens aide was established to service citizens’ complaints by investigating the administrative acts of state agencies and to annually report to the governor, the legislature and the public on its activities.   This office is responsible for investigating acts that it has reason to believe may be:

1.      Contrary to law.

2.      Unreasonable, unfair, oppressive, arbitrary, capricious, an abuse of discretion or unnecessarily discriminatory, even though they may be in accordance with the law.

3.      Based on a mistake of fact or improper or irrelevant grounds.

4.      Unsupported by an adequate statement of reasons.

5.      Performed in an inefficient or discourteous manner or otherwise erroneous.

The qualifications for this position require the ombudsman-citizens aide to be a resident of this state for at least six months, must be at least twenty-five years of age and have experience in investigation.  A person may not serve in this position for at least a year of serving as a state elected official.  The term of office for the ombudsman-citizens aide is for five years beginning on the date of appointment and is a full-time position.   The ombudsman-citizens aide may not serve more than three full terms unless needed to fill in until a successor is appointed.
