HB2069 modifies the requirements that need to be performed when petitioning to change fire, community park maintenance and sanitary district boundaries.

History

Relating to fire, community park maintenance and sanitary districts, current law requires that a boundary impact statement must be submitted to the governing board of the district affected by the boundary change. Upon the approval of the impact statement, the petitioner for the change is required to obtain more than half of the signatures of all of the qualified voters, property owners and persons owning more than half of the value of property within the boundaries of the proposed change. However, there is no date for when the petition must be returned to the governing board.

Provisions

·                      Modifies the number of signatures required for a petition to change district boundaries from more than one-half of all the qualified electors within the district to at least one half of the votes cast for the office of governor in the most recent gubernatorial election.

·                      Requires that the clerk of the governing board determine the fixed number of signatures necessary to fulfill the requirements for the petition within 15 days of the board’s approval of the impact statement.

·                      Clarifies that petitions submitted for verification must meet the requirements set by the county recorder and county assessor.

·                      Establishes that all circulated petitions must be returned to the board within one year or then become void.

·                      Specifies that this act applies to petitions that begin circulation only after this bill becomes effective.

·                      Makes other technical and conforming changes.
